1. What Buddyly is

Buddyly Technologies Pvt. Ltd. (“Buddyly”, “we”) operates a digital marketplace where users book verified companions for one-on-one, non-romantic, non-sexual activities in public places. We are a technology platform and an “intermediary” within the meaning of Section 2(1)(w) and Section 79 of the Information Technology Act, 2000: we provide the verification, booking, payment escrow, chat, and reporting infrastructure around each session, but we do not ourselves provide companionship services, and we do not supervise, direct, or control any session. Companions are independent contractors who offer their own services through the platform — they are not our employees or agents, and nothing they say or do is on our behalf.

2. Eligibility

You must be 18 or older, hold a valid Indian mobile number, and complete phone verification. Companions additionally complete the full identity verification pipeline described on our Safety page before listing. Services involving alcohol additionally require both parties to meet their state's legal drinking age.

3. Your responsibilities

  • Provide accurate, truthful information at signup, verification, and booking.
  • Keep your account and OTP codes to yourself — sessions are personal to you.
  • Respect boundaries and consent at every point in a session, without exception.
  • Report inappropriate behaviour promptly through the in-app report tools.
  • Comply with all laws that apply to you during a session, including venue rules.

4. Prohibited conduct — permanent ban, no refund

The following are banned outright. A violation ends your account permanently and forfeits any pending refund:

  • Romantic or sexual bookings, requests, or advances, in any form.
  • Overnight bookings, for any reason.
  • Meeting at a private residence within the first 5 sessions between the same pair. All venues must be Google-Places-verified public locations.
  • Alcohol beyond legal limits; any illegal substance.
  • Cash or off-platform payment of any kind — including UPI transfers arranged in chat. All payment flows through in-app escrow.
  • Harassment, stalking, discrimination, or contact after a block.

5. Bookings, payments, and escrow

Booking requires an active Buddyly membership (Section 6) and a verified mobile number. Payment is collected in full at booking via Razorpay and held in escrow. Companions are paid 4 hours after both parties confirm the session ended — the dispute window — less Buddyly's 20% platform fee. Cancellation refunds follow the published Refund Policy. Companion no-shows refund you in full and penalise the companion. All amounts are in Indian Rupees and include applicable taxes unless stated otherwise at checkout. Every booking additionally requires you to re-confirm, by checkbox, that you accept these Terms and book at your own discretion and risk — a booking cannot be placed without it.

6. Membership — what it does and doesn't include

A Buddyly membership (from ₹79) is a single account-level access fee that applies to everyone: an active membership is required to place bookings as a user, and to keep a verified companion's profile listed and bookable. It is a one-time purchase for a fixed period — it does not auto-renew. A membership is not a promise of anything else: it does not guarantee any minimum number of bookings, matches, inquiries, sessions, or income, nor any placement in search results, nor the availability of any particular companion or service. Membership fees are non-refundable and non-transferable, except where a refund is required by law, including where you do not complete verification, do not place or receive any bookings, or stop using the platform; unused membership time carries no cash value. Account verification steps (mobile number, email, and for companions, identity documents) are completed after purchase and remain required before booking or listing.

7. For companions: earnings and independence

Listing on Buddyly requires an active membership (Section 6) and completed verification, and we keep a 20% platform fee on bookings you actually complete — you keep the remaining 80%. Be clear-eyed about what we do not promise: we do not guarantee any minimum number of bookings, inquiries, or income, and demand depends on your city, services, rates, and ratings. You are an independent contractor — responsible for your own conduct, taxes, and legal compliance — and you may stop listing at any time.

8. Safety measures and emergencies

You agree to keep sessions in public venues, complete session start/end confirmations honestly, and use the in-app reporting tools truthfully — filing knowingly false reports is a bannable offence. Users must maintain at least 2 emergency contacts before booking; we contact them only in a genuine emergency. Buddyly is not an emergency-response, security, or bodyguard service and does not monitor sessions in real time. In any emergency, contact the police and emergency services on 112 first — in-app reporting is for account review and enforcement, not rescue.

9. Assumption of risk and release

Meeting another person — however carefully verified — carries inherent risk that no platform can eliminate. Our identity checks, venue rules, and payment controls reduce risk; they are not a warranty of any member's conduct, character, or behaviour, and we do not conduct continuous background monitoring of members. You alone decide whether, where, and with whom to meet, and you participate in every session voluntarily, at your own discretion and risk. To the maximum extent permitted by law, you release Buddyly from claims arising out of the acts or omissions of other members, including a companion or user you met through the platform, except to the extent a claim is caused by our own negligence or wilful default.

10. Ratings and account standing

Ratings are mutual. A companion averaging below 3.5 receives coaching; below 3.0 is delisted. Users with repeated poor conduct ratings can be removed with the same thresholds.

11. Platform availability

The platform is provided on an “as is” and “as available” basis. We work hard to keep it up, but we do not guarantee continuous, uninterrupted access, and we may modify or withdraw features with reasonable notice where practical.

12. Limitation of liability

Sessions happen in the real world between adults, and each participant remains responsible for their own conduct on and off the platform. To the maximum extent permitted by law: (a) we are not liable for the acts or omissions of any user or companion, including personal injury, loss, or damage arising during or after a session; (b) we are not liable for indirect, incidental, or consequential losses; and (c) our total aggregate liability for any claim is limited to the amount you paid Buddyly for the booking concerned or, where no booking is concerned, the platform fees you paid us in the 3 months before the claim. Nothing in these terms limits liability that cannot be limited under Indian law.

13. Indemnification

You agree to indemnify Buddyly, its directors, employees, and agents against claims, losses, or expenses arising from your breach of these terms or your unlawful conduct on or around a session. This clause does not apply to claims caused by our own negligence or failure of the platform itself.

14. Governing law and grievances

These terms are governed by Indian law. Complaints go first to our Grievance Officer — see the Grievance Redressal page — who responds within the statutory timelines of the Information Technology Act, 2000 and DPDP Act, 2023.
